These Terms of Service (“Terms”) are a legal agreement between you and City Games LLC (“City Games,” “we,” “us,” or “our”), governing your use of the City Games mobile application, website (citygames.co), and related services (collectively, the “Service”).
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
City Games is a location-based game. Players complete challenges — including trivia, GPS check-ins, QR code scans, photo and video submissions, puzzles, and scavenger hunts — in and around participating cities. Local businesses sponsor portions of the game and may offer rewards, coupons, or prizes to players who complete challenges.
You must be at least 13 years old to use the Service. If you are between 13 and 17, you may only use the Service with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf. Some rewards or challenges may require you to be 18 or older (for example, challenges involving bars, breweries, or other age-restricted venues), and you may not attempt those challenges if you are under the required age.
You agree to provide accurate information when creating an account, keep your login credentials confidential, and accept responsibility for all activity under your account. You may not create more than one account, share an account, or transfer an account to anyone else. We may suspend or terminate accounts that violate these Terms.
City Games involves real-world movement and exploration. You are solely responsible for your own safety while playing. You agree to:
Challenge locations are suggestions, not guarantees of safety, accessibility, or legality of access. Conditions in the real world change. If a challenge appears to require unsafe or unlawful activity, do not attempt it and report it to us.
To the fullest extent permitted by law, you assume all risks associated with playing City Games in the physical world, including risk of property damage, personal injury, or death.

We may remove points, revoke rewards, reset progress, or suspend or permanently ban accounts for violations, at our sole discretion and without compensation.
Sponsors — not City Games — are responsible for honoring and fulfilling coupons, discounts, and rewards offered through the Service, unless we expressly state otherwise. Rewards:
We are not responsible if a sponsor closes, changes its offer, or fails to honor a reward, though we will make reasonable efforts to address player reports of problems. Contests, sweepstakes, or prize drawings, if offered, may be governed by separate official rules that will be posted with the relevant promotion.
Some challenges ask you to submit photos, videos, or other content (“User Content”). By submitting User Content, you grant City Games a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, display, distribute, modify, and create derivative works of that content in connection with operating, promoting, and marketing the Service. This license survives termination of your account.
You represent that you own or have the necessary rights to any User Content you submit, that it does not violate anyone’s rights (including privacy and publicity rights of people appearing in your photos or videos), and that it complies with these Terms.
You may not submit content that is illegal, obscene, hateful, harassing, violent, infringing, or that depicts dangerous activity. We may review, moderate, remove, or refuse any User Content at our discretion, but we are not obligated to monitor it.
Your username, score, badges, and certain activity may be displayed publicly within the Service, including on leaderboards. Choose a username accordingly. We may remove usernames that are offensive or impersonate others.
The Service — including software, game design, challenge content, trademarks, logos, and branding — is owned by City Games or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the Service except as permitted by law.
Sponsor names, logos, and marks belong to their respective owners. Their appearance in the Service does not imply any endorsement beyond the sponsorship relationship.
Sponsors pay City Games for placement, challenges, and visibility within the Service. Sponsored content is part of the game experience. City Games does not endorse and is not responsible for the products, services, conduct, or premises of any sponsor.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, for violation of these Terms or for any other reason at our discretion. Upon termination, your license to use the Service ends and accumulated points, badges, and unredeemed rewards may be forfeited without compensation.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT LOCATION DATA WILL BE ACCURATE, OR THAT ANY CHALLENGE LOCATION IS SAFE OR ACCESSIBLE.
TO THE FULLEST EXTENT PERMITTED BY LAW, CITY GAMES AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND SPONSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS ARISING FROM YOUR USE OF THE SERVICE OR YOUR REAL-WORLD ACTIVITY WHILE PLAYING. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) FIFTY DOLLARS ($50).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless City Games and its owners, employees, contractors, and sponsors from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, your violation of these Terms, or your violation of any law or third-party right while playing.
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules.
Any dispute arising from these Terms or the Service will be resolved by binding individual arbitration in Kent County, Michigan, administered under the rules of the American Arbitration Association. You and City Games each waive the right to a jury trial and the right to participate in a class action. You may opt out of this arbitration provision by emailing toby@citygames.co within 30 days of first accepting these Terms.
If arbitration is found unenforceable, disputes will be resolved exclusively in the state or federal courts located in Kent County, Michigan, and you consent to their jurisdiction.
We may update these Terms from time to time. If changes are material, we will provide notice through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms, together with the Privacy Policy and any posted promotion rules, are the entire agreement between you and City Games regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
